Should British citizens who fight in Israel’s army face prosecution when they return?

Serving in a foreign army is not generally a crime in the UK. The Foreign Enlistment Act 1870 bans Britons from serving a state at war with a state at peace with the UK, and the government has said it does not apply to the IDF. In April 2026 a magistrate refused a private prosecution under the Act, calling it vexatious. The Met Police declined a war crimes probe into 10 Britons who served in the IDF in 2026, then reopened a scoping exercise on four in July 2026. Estimates suggest over 2,000 British nationals have served in the IDF since 2023.

All the lefties peeing their pants over a fake ‘genocide’. Sadly predictable.

Serving in their Army is lawful so shouldn’t be punished. Especially as Israel is fighting for its life against an Iran financed terrorist onslaught.

Voluntarily signing up to commit genocide should - in a sane world - be met with consequences.

Did we prosecute those that went to fight for Ukraine?
